[ARCHIVED] NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that at 5:00 p.m., on October 11, 2022, in Council Chambers at Artesia City Hall, 511 West Texas Avenue, Artesia, New Mexico, the Artesia City Council will hold a public hearing to consider the following:

 

Consideration of adopting Section 1. Section 5-2A-1 of Ordinance No. 846, passed, adopted, and approved by the City of Artesia, on August 24, 2010, is hereby amended so that the following definition is inserted immediately before the definition of “GROOMING PARLOR”:

“FEE: A charge for labor or service provided by the City of Artesia. The amount of each fee shall be adopted by resolution of the City of Artesia, New Mexico. The following fees apply:

  1. Adoption Fee: The fee charged for an adoption, subject to the requirements contained in this Article.
  2. Deposit for Sterilization: The City of Artesia will retain a Deposit for Sterilization for animals for which proof of sterilization has not been provided for thirty (30) days. If proof of sterilization is not provided within this time, the Deposit for Sterilization will be forfeited. An owner will not be charged this fee for an animal that is already sterilized.
  3. Impound Fee, First Offense: The fee charged for the first time an animal is impounded.
  4. Impound Fee, Second Offense: The fee charged for the second time an animal is impounded.
  5. Impound Fee, Third Offense: The fee charged for the third time an animal is impounded.
  6. Microchip Implant Fee: The fee charged for the implantation of a microchip. An owner will not be charged this fee for an animal that is already microchipped.
  7. Owner Release Fee: The fee charged for the release of an animal to an owner.
  8. Permit Application or Renewal Fee: The fee charged for processing the application or renewal of a permit required by this Article.”

Section 2. Section 5-2A-7 of Ordinance No. 846, passed, adopted, and approved by the City of Artesia, on August 24, 2010, is hereby amended as follows:

“A.    Impoundment And Destruction: Dogs and cats not licensed and/or not vaccinated for rabies and dogs and cats running at large may be caught and impounded in the shelter provided by the city, and, if not redeemed by the owner within seventy two (72) hours, such dogs and cats may be destroyed by the humane officer or his/her designee.

B.    Impoundment Of Unlicensed, Unvaccinated Or At Large Dogs And Cats: The humane officer and any police officer of the city may impound any dog or cat not licensed or vaccinated and any dog or cat running at large.

C.    Redemption Provisions: In order to redeem any dog or cat impounded under the provisions of this article, the owner or the custodian of such dog or cat must appear within seventy two (72) hours and do the following:

      1.    Pay the associated fees required to license the animal if the animal is not licensed,

      2.    Furnish satisfactory evidence of vaccination and spay or neuter or produce a prepaid receipt for vaccination and spay and neuter by a licensed veterinarian, and

      3.    Pay a First Offense, Second Offense, or Third Offense impoundment fee.  An adoption fee and criminal fines will also apply for the third and any subsequent impoundments of the animal.”

NOTICE IS FURTHER GIVEN that all persons are invited to attend and may be heard at such public hearing.
